• Limitation of Liability: Frostify Designs LLC is not liable for any indirect, incidental, or consequential damages arising from the use of deliverables or services. Frostify Designs LLC's total liability is limited to the amount paid by the Client for the specific service or project.

• Third-Party Materials: Frostify Designs LLC is not responsible for the functionality or content of third-party platforms or software used in the course of providing services.

4. Use of Testimonials and Portfolio Display

By engaging Frostify Designs LLC services, you agree that completed work may be included in portfolio or marketing materials unless explicitly stated otherwise in writing. If you provide a testimonial or review, you grant permission for its use on the company website and promotional materials.

5. Website Use and Cookies

If a project is refused after payment has been made, a refund will be issued for any work not yet performed. However, no refunds will be issued for completed milestones or deliverables.

7. Project Agreements and Payment Terms

All projects undertaken by Frostify Designs LLC are subject to a mutually agreed-upon written agreement (“Project Agreement”) that outlines the specific terms, deliverables, timelines, and payment structure for the project. The following general terms apply to all Project Agreements:

• Scope of Work: The scope of the project, including deliverables and services, will be detailed in the Project Agreement. Any changes to the agreed scope must be requested in writing and may result in additional charges or revised timelines.

• Payment Terms: Payment schedules, including deposits, installment payments, and final balances, will be clearly outlined in the Project Agreement or invoice. Full payment may be required before the delivery of final work.

• Revisions: The number of revisions included will be specified in the Project Agreement. Additional revisions beyond the agreed limit may incur extra charges.

• Approval and Acceptance: Once a deliverable has been reviewed and approved by the Client, the project will be considered complete. Subsequent changes or corrections will be billed as a new task or phase.

• Refund Policy: Deposits and payments are non-refundable once work has commenced, except in cases where Frostify Designs LLC is unable to fulfill the agreed-upon scope of work.

By engaging Frostify Designs LLC, you acknowledge that no work will begin until a Project Agreement has been signed, and all required deposits have been received. This ensures clarity, mutual understanding, and the efficient completion of your project.

8. Changes to Terms and Conditions

Frostify Designs LLC reserves the right to update or modify these Terms and Conditions at any time. Updates will be posted on this page, and the “Effective Date” will reflect the date of the latest changes. Continued use of this website or services constitutes acceptance of the revised Terms.

9. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of New Mexico, United States.

• Dispute Resolution: Any disputes arising under these Terms will first be attempted to be resolved amicably through written communication. If no resolution is reached, disputes will be subject to the exclusive jurisdiction of the courts in New Mexico.
